Terms of Use

Käesolevad kasutustingimused (edaspidi „Tingimused“) reguleerivad veebilehe kadakakoda.ee (edaspidi „Veebileht“) kasutamist ning seal pakutavate toodete tellimist ja teenuste (nt ringkäigud, töötoad) broneerimist.

By using the website, you agree to the Terms and Conditions and undertake to comply with them. If you do not agree to the Terms, please do not use the Website.

1. General provisions

1.1. The Terms apply to all users of the Website (hereinafter referred to as the “User”), including natural and legal persons who order products or book services via the contact form.
1.2. In addition to the Terms, the use of the Website and transactions are regulated by the legislation of the Republic of Estonia, including the Law of Obligations Act and the Personal Data Protection Act.
1.3. The Seller may change the Terms at any time by notifying the same on the Website. Changes shall enter into force upon publication, unless otherwise stated. Orders and reservations shall be subject to the Terms in force at the time of the transaction.
 

2. Website content and intellectual property

2.1. The content of the Website (text, images, graphics, etc.) is protected by copyright and belongs to the Seller or its partners. Copying or using the content without the Seller’s written consent is prohibited.
2.2. The User may use the content only for personal, non-commercial purposes, in accordance with the Terms.
2.3. Product and service descriptions on the Website are informative. The Seller may change them at any time.
 

3. Ordering products via the contact form

3.1. Placing an order
  • To order products, the User fills out the contact form on the Website, indicating the desired products, name, contact details and delivery address. kontaktvormi , märkides soovitud tooted, nime, kontaktandmed ja tarneaadressi.
  • The Seller contacts the User by e-mail (saaremaa@kadakakoda.ee) or by phone, sending the product prices, delivery costs and payment information.
  • The order is confirmed if the User agrees to the terms and conditions sent by the Seller. The User is responsible for the accuracy of the information provided.
3.2. Prices and payments
  • The prices of the products are not published on the Website. The Seller sends the prices to the User after placing the order. The prices are in euros and include VAT. Delivery costs are added according to the agreed delivery method.
  • Payment is made on the basis of the invoice sent by the Seller by bank transfer or in another agreed manner.
  • The sales contract enters into force when the purchase amount has been received in the Seller's bank account.
3.3. Delivery time and methods
  • The products will be delivered to the User via the agreed delivery method (e.g. Omniva, SmartPOST) within 5 working days from the receipt of payment, unless otherwise agreed.
  • If the User does not collect the product from the parcel terminal within 7 calendar days, it will be returned to the Seller. Repeated delivery will be at the User's expense.
3.4. Right of withdrawal
  • The User who is a natural person has the right to withdraw from the contract within 14 calendar days from the receipt of the product, by notifying the Seller thereof (e-mail: saaremaa@kadakakoda.ee).
  • The returned product must be unused, in its original packaging and in the same condition.
  • The direct costs of return (e.g. postage) are borne by the User, except in the case of a defective or incorrect product.
  • The Seller will refund the purchase price (including the original delivery cost) within 14 days from the return of the product.
3.5. Claims and defective products
  • A claim regarding product non-conformity or defects must be submitted within 2 months of the discovery of the defect (e-mail: saaremaa@kadakakoda.ee).
  • The Seller will review the claim within 15 days and offer a solution (replacement or refund).
  • The Seller is not responsible for defects that have arisen through the fault of the User.

4. Booking services via the contact form

4.1. To book services (e.g. tours, workshops), the User fills out the contact form, indicating the desired service, time and contact details.
4.2. The Seller confirms the booking by e-mail (saaremaa@kadakakoda.ee) or by phone, sending the final price of the service, payment information and, if necessary, an invoice for the prepayment.
4.3. If the booking is cancelled at least 48 hours before the service, the prepayment will be refunded in full. In case of later cancellation, the prepayment will not be refunded.
4.4. The Seller may cancel or change the services (e.g. due to weather), notifying the User as soon as possible. The advance payment will be refunded or a new time will be offered.
 

5. Processing of personal data

5.1. The Seller processes the User's data (name, e-mail, telephone, delivery address) to fulfill orders and reservations in accordance with the GDPR and Estonian laws.
5.2. Data is transferred to third parties (e.g. courier services) only for the purpose of fulfilling the order.
5.3. The User may request to review, correct or delete their data by sending a request to saaremaa@kadakakoda.ee.

6. Cookies

6.1. The Website uses cookies to improve the user experience and collect statistics (e.g. Google Analytics).
6.2. Cookies are accepted by continuing to browse the Website. Cookies can be disabled in the browser settings.
 

7. Dispute resolution

7.1. Disputes shall be resolved by negotiation. If no agreement is reached, the dispute shall be resolved in Harju County Court.
7.2. The consumer may contact the Consumer Protection and Technical Surveillance Authority or use the ODR platform.
